Hugs And Words Project Ltd. ("Hugs And Words") (and its affiliates "Hugs And Words", or "us") welcomes you (the User(s)") to our website www.hugsandwords.com (and all its subdomains (the “Site”)), which contains general information about Hugs And Words, its Services and our mobile app (the „App“), which provides an online platform to deal with loss aspects (the «Services» as further described below). You may use the Site and App as you wish, provided that you comply with these terms and conditions.

General
These Terms are the complete terms and conditions between Hugs And Words and you relating to the subject matter. They supersede all prior or contemporaneous oral or written agreements or understandings between Hugs And Words. (b) The laws of Finland will govern and interpret any claim relating to the App and/or the Content. (c) All disputes arising from or related to the App and/or Site will be brought in and you consent to exclusive jurisdiction in Helsinki, Finlandl. You waive any defenses of forum non-conveniens or lack of personal jurisdiction and agree that the process may be served in accordance with applicable law. Hugs and Words can seek injunctive relief from any court with jurisdiction. (d) These Terms do not, and shall not, be construed to create any relationship, partnership, joint venture, or employer-employee, agency, or franchisor-franchisee relationship between the parties hereto. (e) The waiver by any party of any breach of default under these Terms will not be interpreted as a waiver of any previous or subsequent breach of default. Any heading, caption or section title included herein are inserted solely for convenience and do not define or explain any section or provision. (f) Any cause of action you might have in connection with the Site, the App, or the Services must be filed within one (1) year of the cause of action. Any other cause of action will be permanently barred. (g) Any provision of these Terms that is deemed unenforceable by any court having competent jurisdiction shall be reduced or eliminated to ensure that they remain in full force and effect, while closest to conforming to the intent. Without our written consent, you may not assign or transfer the Terms (including any rights and obligations thereunder), and any attempt to do otherwise in violation of this provision shall be null. These Terms may be assigned or transferred by us without restriction or notification. (i) Any amendments to these Terms will not be binding unless they are in writing and signed off by Hugs and Words. (j) All correspondence regarding these Terms must be in English.

1. Acceptance of these Terms
By entering, connecting to, accessing or using the Site and by entering, connecting to, accessing, using, installing and/or downloading the App on your mobile phone, device or tablet that you own or control, you acknowledge that you have read and understood the following terms of use, including the terms of our Privacy Policy available at: hugsandndwords.com/privacy (the "Privacy Policy") (collectively, the "Terms"), and you agree to be bound by them and to comply with all applicable laws and regulations regarding your use of the Site and/or the App, and you acknowledge that these Terms constitute a binding and enforceable legal contract between Hugs And Words and you. You must agree to these terms before you can access, connect to, use, or access the Site or the App. If you don't agree, you should not install the app on your device, tablet, or mobile phone.
The App and the related Services are only available to those who are (a) at least eighteen (18 years old; (b) have the legal capacity to agree to these Terms. You represent and warrant that your legal age is sufficient to create a binding contract.

2. The Services
Hugs and Words is an online platform that helps you deal with loss. You can get guidance about what to do and how you can handle the many tasks involved in dealing with the loss. You can use the Services to receive advice, support, tools, and information about these steps.

The Platform also offers the ability to scan and upload any relevant documents to your account (referred to as "Vault") and support services via live chat or telephone call with Hugs And Words representatives (referred to as "Helpline")
Hugs and Words is also covered in the Site, App and Blog. This includes news, updates, blogs, and videos.
The Site or the App could include push notifications, messages, and alerts via various communication channels.
(Collectively: The "Service(s),")

Hugs and Words retains all rights to and content on the Site/App. The Site,/or App and/or Content and/or User-Generated content are provided "as is" and "as readily available" to the extent permitted by law. Hugs and Words is not responsible for any damages, loss, or injuries that you or anyone else may suffer as a result or in connection to your use of the Website and/or App and/or Services and/or Content and/or User-Generated content.
Site, App, and/or Services are intended for informational purposes only. They are not intended as professional advice. You use the Services, including the App, Content, and/or User-Generated Content, at your own risk. Hugs and Words does not endorse any recommendations made by its representatives to Users.
We cannot guarantee that backups will be available for data we process as part of our Services. As such, we are not able to guarantee that such data will be available. We do not provide any archive services to store such data. We are not responsible for any unauthorised access to, use, or security intrusions, storage failures, or any other damage to such data. We are unable to guarantee the confidentiality of any information you provide us.
All User-Generated Content, which is provided to Hugs and Words by the relevant User is not verified by Hugs and Words. Hugs & Words does not bind Hugs & Words in any way.
We reserve the right to refuse to provide Services to any person, for any reason, or no reason at all, subject to the applicable law.

3. Register and create a User Account
To use the App, you will need to download it from the relevant mobile app marketplace.
You must register for and create an Account (the "Account") to access the Services. This account will be created using a mobile number. We further explain this in our Privacy Policy. You represent and warrant that when you create an account with us, that you are at least 18 years old, that you have the legal capacity and legal authority to enter into these Terms, to make binding agreements under any applicable law, and that you can use the Services in accordance with these Terms. You warrant and represent that all information provided to us is current, accurate, and complete at all times. Your Account may be terminated immediately if it contains incorrect, incomplete or outdated information.
You are responsible to protect your password and account confidentiality, including the restriction of access to your computer and mobile device. You accept full responsibility for all activities and actions that take place under your Account or password. You agree to exit your account at the end of each session. Accessing your account via a shared or public computer is a good idea to ensure that no one else has access to your password or any other personal information. Hugs and Words must also be given prior written consent. Any unauthorized use of your account or other security breach must be reported immediately to Hugs and Words. In such cases, you will need to change your password via the App settings. We are not responsible for any loss or damage that may result from your failure to follow these Terms.

If you wish to cancel and remove your Account, please use the applicable functionality within the App or send us an email of your request to: hello@hugsandwordsHugs Your Account will terminate within a reasonable time period following your request, and from that date of termination you will no longer be able to access your Account.
Cancelling your account could result in the loss of some information (including documents uploaded to the Vault service) as well as the ability of your account. We are not responsible for any loss.
Hugs And Words will need certain information in order to use the services. This includes personal identifiable information. Hugs And Words may need to have access to and/or use information that you provide to Hugs And Words in order to provide the Services. You acknowledge and consent to this. Our Privacy Policy provides a detailed explanation of the information we collect from our Users.
Any username, password or other identifier that you choose or provide to us can be disabled at any time, for any reason. This includes if we believe you have violated any of the Terms.

4. Take into account
Our Site is available for free, but our App and related Services are only available to users who have signed up to an Account. Fees may apply after any free trial period. Hugs and Words's Partners will cover the cost of your use of our app. During your Account subscription, the following payment terms will apply:

Payment is made through the App. We may, but are not obliged to, offer a free trial subscription or any other benefits at our sole discretion.
After the trial period expires, your subscription will be charged. If you don't provide your credit card information or any other payment information prior to the expiration of the free trial period, your access to your Account may be restricted (at the Company’s sole discretion) until payment information is received and authorization for a charge. Your Account access will be updated automatically after that. After payment is received, you will be issued a receipt.
Except as stated otherwise, our charges do NOT include taxes, levies or duties, or other governmental assessments such as VAT or sales taxes. Except for taxes assessed against Hugs and Words based upon its revenue, you are responsible to pay all Taxes. If we feel we have a legal duty to invoice you, we will invoice you for such taxes.
We reserve the right to charge fees for features and services that are made available through our App and Site in the future. We also reserve the right to change the fees and prices of our Services at any given time at our sole discretion. These pricing changes will not affect any subscriptions already paid. Before any fees or charges relating to such use are implemented, we will notify you by posting a notice on the Site and/or App.

Your subscription payments will be processed by the Platform Provider (as described below) such as Google Play, Apple App Store, or the original location where you downloaded the App ("In-App Purchase") The terms and conditions of the Platform Providers will apply if you make an In-App purchase. You should contact the Platform Provider directly if you have payment issues related to In-App Purchases. The Platform Provider's terms & conditions may provide more information on managing In-App purchases using your device. It is your responsibility and obligation to adhere to all terms and policies of the Platform Providers. You also acknowledge and agree that payment processing is handled by the Platform Provider.

5. Use restrictions
When using the Services, certain conduct and activities are strictly prohibited. Please carefully review the following restrictions. Hugs And Words reserves the right to terminate your use of the Services for non-compliance with these provisions. You may also be subject to civil and/or penal liability.
Without Hugs and Words' written permission, you cannot use the Site/App and/or any Content or User-Generated Content for illegal, immoral, illegal, and/or unauthorized purposes.

You may not (and you may not permit any third-party to) unless otherwise explicitly permitted under these Terms: (a) use the Site and/or the App and/or the Content and/or the User-Generated Content for any illegal, immoral, unlawful and/or unauthorized purposes(including, without limitation, any laws regarding the export of data or software to and from the US or other countries); (b) use the Site and/or the App and/or the Content and/or the User-Generated Content for non-personal or commercial purposes without Hugs And Words’s express prior written consent; (c) Frame or utilize framing techniques or caches to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) on the Site or App or remove or disassociate, from the Content and/or the Site and/or the App and/or the User-Generated Content any restrictions and signs indicating proprietary rights of Hugs And Words or its licensors, including but not limited to any proprietary notices contained in such materials (such as ©,™, or ®), and you represent and warrant that you will abide by all applicable laws in this respect; (d) interfere with or violate Users’ rights to privacy and other rights, or harvest or collect personally identifiable information about Users without their express consent, whether manually or with the use of any robot, spider or crawler, or any search or retrieval application, or use other manual or automatic device, process or method to access the Site and/or the App and retrieve, index and/or data-mine information; (e) interfere with or disrupt the operation of the Site and/or the App or the servers or networks that host the Site and/or the App, or disobey any laws, regulations, requirements, procedures or policies of such servers or networks; (f) impersonate or attempt to impersonate, falsely state or otherwise misrepresent your affiliation with any person or entity, or express or imply that Hugs And Words endorses you, your site, your business or any statement you make, or present false or inaccurate information about the Services; (g) take any action that imposes, or may impose, an unreasonable or disproportionately large load on our platform infrastructure, as determined by us; (h) bypass any measures we may use to prevent or restrict access to the Site and/or the App or the server on which the Site or App is stored, or any server, computer, or database connected to the Site or the App; (i) copy, modify, alter, adapt, replicate, make available, translate, port, reverse engineer, decompile, or disassemble any portion of the Content made available by Hugs And Words on or through the Site and/or the App, or publicly display, reproduce, create derivative works from, perform, distribute, or otherwise use such Content and/or User-Generated Content; (j) copy, distribute, display, execute publicly, make available to the public, reduce to human readable form, decompile, disassemble, adapt, sublicense, make any commercial use of, sell, rent, transfer, lend, process, compile, reverse engineer, combine with other software, translate, modify or create derivative works of any material that is subject to Hugs And Words’s proprietary rights, including Hugs And Words’s Intellectual Property (as such term is defined below), in any way or by any means, unless expressly permitted in the Terms and/or under any applicable laws which expressly permits such actions; (k) make any use of the Content and/or use-generated Content on any other site or networked computer environment for any purpose without Hugs And Words’s prior written consent; (l) create a browser or border environment around Hugs And Words’s Content (no frames or inline linking is allowed); (m) sell, licence or exploit for any commercial purposes any use of or access to the Site and/or the App and/or the Content and/or the User-Generated Content; (n) frame or mirror any part of the Site and/or the App without Hugs And Words prior express written authorization; (o) create a database by systematically downloading and storing all or any of the Content and/or User-Generated Content from the Site and/or the App; (p) transmit or otherwise make available in connection with the Site and/or the App any virus, worm, trojan horse, time bomb, web bug, spyware, or any other computer code, file or program that may or is intended to damage or hijack the operation of any hardware, software or telecommunications equipment, or any other actually or potentially harmful, disruptive or invasive code or component; (q) use the Services for any purpose for which the Site and/or the App and/or the Services are not intended; (r) infringe and/or violate any of the Terms; (s) transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any "junk mail," "chain letter," "spam," or any other similar solicitation ; and/or (t) engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Site, the App, and/or the Services, or which, as determined by us, may harm us or users of the Site, App and/or Services or expose them to liability.

6. Privacy Policy
We respect your privacy. We are committed to protecting any information you provide us. You have the right to see our data collection practices when you use, access, or connect to the Site and/or App. Our policy and practices and the type of information collected are described in detail in our Privacy Policy, which is provided hereinafter and also at: www.hugsandwords.com/privacy. Before you can connect to, access, or use the Site or App, you need to read and accept the Privacy Policy.

7. User-generated Content
You may be able to upload, publish, make available and make available your own copyrightable materials through the App, such as images, literary works, and text material (the "User Generated Content") You must ensure that you are aware of the rights to your User-Generated content, including intellectual property rights and privacy rights. Hugs and Words is not responsible for any loss, injury, cost, or expense you might suffer as a result or in connection to uploading User-Generated content.
So long as the User-Generated content is subject to applicable copyright laws, such User-Generated Content shall remain, at any time and to the extent allowed by law, the exclusive and sole property of the User.
You agree and understand that your User-Generated content and any consequences of publishing or posting such material on the App are entirely your responsibility.
You warrant and represent that you are the owner of all User-Generated Content uploaded to the App, and that you have (and continue to have) all necessary licences and rights from the rightful owners.
It is the responsibility of the user to obtain all consents required by any applicable laws in relation to the posting of personal information about others as part of the User-Generated content, and to comply with any applicable laws.
Except as permitted by law, the User-Generated content will not contain unsolicited advertising, promotions, contests, or raffles, except as explicitly stated herein.
You agree to not upload or post any User-Generated content that is illegal for you to own, post, upload or use in the country where you live or for Hugs And Words in connection with the App and/or Site (including any content that's defamatory or libelous or pornographic, indecent or harassing, threatening or discriminatory, abusive, fraudulent, abusive, or discriminatory).

Hugs And Words is not obligated to monitor, screen, or modify any User-Generated Content. However, Hugs And Words expressly reserves the right to remove or alter any User-Generated Content from the App at its sole discretion. You are responsible for creating backup copies and replacing any User–Generated Content that you store or post on the App.
Hugs And Words, our affiliates and providers of service, as well as each of their successors and licensees, grants Hugs And Words an irrevocable perpetual, non-exclusive and royalty-free licence to use, reproduce and distribute, transmit and create derivative works from, display, copy, perform, and display any User Generated Content in connection to the Site and/or App and/or Services. Hugs And Words may also publish and use any User Generated Content without the User's consent. You agree that User-Generated content may not be transferred to third parties without your prior consent. Hugs and Words will not be held responsible for the User-Generated content being used by third parties. You also expressly waive any moral rights you might have in or to the User Generated Content. Furthermore, you forever waive and agree to not claim any entitlement to any and every moral right in the User Generated Content.
Hugs And Words assumes no responsibility or liability for User-Generated Content you upload, publish, make available, or made available to you by any third party through the App. Hugs And Words is also not liable for any errors, defamation or falsehoods you may encounter via the App and/or the Site.

8. Copyright Violations and Misconduct
Hugs and Words respects intellectual property rights. If you believe your work has been copied in violation of copyright infringement or if any Content on the Site or the App (including User Generated Content) violates your privacy rights, (i) an electronic signature from the person who is authorized to act for the owner of the copyright; and (iii), a description or description of the copyrighted material you claim is infringing. Hugs And Words will need this information to locate the material. (iv). A declaration that you believe the disputed use was not authorized by the copyright owners, their agent, or the law. Your statement at the bottom of your notice is exactly as follows: "I hereby swear, under penalty of perjury, that the above information I have provided is correct and that I am either the copyright owner or authorized to act for the copyright owner.

We have adopted a policy to terminate accounts and/or pursue other remedies in accordance with the Digital Millennium Copyright Act, and any other applicable laws.

9. Intellectual Property Rights
Hugs and Words grants you, subject to these terms, a personal, limited, nonexclusive, not-transferable and non-sublicensable licence (i), to download the App to your authorized mobile phone or tablet, but only for the purpose of using it for your internal, noncommercial use. (ii) To use the Services and Content on the Site or the App in accordance with this Agreement.
Hugs And Words owns and/or licences the Site and/or App, the Content, Hugs And Words's intellectual property assets, and all rights thereto, including inventions, patents and applications, trademarks and trade names, service marks and copyrightable material (collectively, "Intellectual Property") and are protected under applicable copyright and other IP laws and international conventions and agreements. Hugs And Words reserves all rights not explicitly granted to you under this agreement.
These Terms don't give you any rights in Hugs And Words intellectual property. However, they do grant you a limited, revocable right to use the Terms as described. Hugs and Words's Intellectual Property is not waived by these Terms.
Hugs And Words will have an exclusive, royalty free, fully paid up worldwide, perpetual, irrevocable licence (the "Feedback") to use your feedback and suggestions regarding the Site, the App, and/or Services. All such Feedback will be considered non-confidential. You also warrant that your Feedback does not come under any licence terms that would require Hugs And Words or any other company to adhere to additional obligations in relation to Hugs And Words's future products, technologies, or services that include any Feedback.
Hugs and Words is not obligated to offer upgrades or new releases of its Site or App in accordance with these Terms.

10. Trademarks and Trade Names
Hugs And Words's logos, marks, and other proprietary identifiers used in connection to the Services ("Hugs And Words Trademarks") by Hugs And Words are trademarks and/or trade name of Hugs And Words. Any other trademarks, service marks and trade names that might appear on the App and/or the Site are owned by their respective owners ("Third Party Marks"). Hugs And Words Trademarks, as well as the Third-Party Marks, are not subject to any right, licence, or interest. You agree to waive any rights, licences, or interests in Hugs And Words Trademarks, or Third-Party Marks. The App's look and feel, including page headers, custom graphics and button icons, are our service marks, trademarks, and/or trade dresses. They may not be copied, imitated, or used in any way without our written permission. Any reference to products, services or processes, whether by trade name, trademark or manufacturer, supplier, or any other means, does not imply endorsement, sponsorship, recommendation, or affiliation with us.

11. Linking to Hugs and Words Site, as well as links to third-party sites
Links to any page of our Site are welcome. It is possible to create a hyperlink to our Site from any hypertext. However, the link must not indicate or imply any connection to Hugs and Words or its products or services. The link should not be false or offensive to Hugs and Words. It is prohibited to link to our Site via a website you don't own or have permission to use. If you link to Hugs and Words Site, it is your responsibility to ensure that your site doesn't contain any content that violates third-party rights or is not unlawful or offensive. We do not allow framing or inline links.
Some links within the Site or the App allow our Users to leave this Site and/or App and access non-Hugs And Words websites and services. These links and services are provided as a convenience only. Hugs And Words does not control these linked sites or services. Hugs And Words cannot be held responsible for the availability of any external sites or services. Hugs And Words is not responsible for or liable in relation to any content or links contained on such linked sites or services. Hugs And Words cannot be held responsible for the privacy policies and/or other practices of linked sites or services. You are responsible for your own actions and risk when you access, use, or rely upon such sites, content, and any dealings with third parties. Hugs and Words reserves all rights to end any link at its discretion. Hugs And Words is not responsible for or liable for any damage or loss that may be caused by the use or reliance of any linked sites or resources. Many of these linked sites or services have their own legal documents that include terms of use and privacy policies. We encourage you to carefully read these documents before you use those services or sites.

12. Usage Guidelines
You may be downloading the App from a third-party platform, distributor, or service provider ("Platform Provider"), and your use of it may also be subject to usage rules the Platform Provider may have set up that apply to your use of this App ("Usage Rules"). While certain Usage Rules will be described, other Usage Rules could apply. It is up to you to determine which Usage Rules apply to your use. The applicable Usage Rules for your use of the app are incorporated by reference. You agree to follow all applicable Platform Provider's Usage Rules. If there is a conflict between these Terms and any applicable Usage Rules, which only relate to the Platform Provider’s representations, warranties or restrictions on the App's use, obligations, limitation on liability (to the extent that they are applicable to the Platform Provider), or any other provisions that impose any responsibility upon the Platform Provider, then the terms of the applicable Platform Provider’s Usage Rules will prevail. The App is not prohibited from you by any laws or Usage Rules. Anyone who is prohibited by applicable laws or Usage Rules, from downloading and/or using this App, is explicitly prohibited.

13. Social Media Features
The Services might include social sharing and publishing features and other integrated tools (for instance, Facebook "Like", "Share" and buttons, sharing content via Twitter, YouTube, and Google+, as well as sharing and uploading content via email, YouTube, Facebook, and Google+. (the "Social Features").
Social Features allow social integration with third-party social networks and platforms ("Social Network" and "Social Network Platform"), or are operated by them. These features are maintained and created by third parties and are not controlled or affiliated with Hugs and Words. This integration will make your use of the Social Features subject to the terms and privacy policies of the relevant third-party Social Network Platform or Social Network Platform. You can opt out of the integration between the App and Social Networks. However, you might not be able to access all the features on our Services if you don't agree with these terms. Hugs and Words does not endorse or accept responsibility for the content of these Social Networks or Social Network Platforms.

14. Additional provisions regarding Third-Party Components
The App and the Site may contain third-party software, files, and components. These components are open-source and third-party licensed ("Third-Party Components"). Any applicable acknowledgements or licence terms that accompany such Third Party Components or are related to them, as well as any other restrictions, will govern your right to use these Third-Party components in connection with the App and/or the Site. These Terms and the licensing terms for such Third-Party components may conflict. In this case, the licensing terms for the Third-Party components shall apply to the related Third Party Components. These Terms do NOT apply to Third-Party Contents contained on the Site or App. Hugs And Words assumes no liability for any such Third-Party Contents. Hugs And Words does not own, licence, or author any Third-Party components. Hugs And Words also disclaims all warranties and representations regarding the suitability, quality, operation, performance, or capabilities of Third-Party components. The Site and/or any portion thereof, except for Third-Party components contained therein, shall not be considered "open source" or "publicly accessible" software.

15. Availability
Many factors affect the availability and functionality of the Services, including communication networks. Hugs and Words cannot guarantee or warrant that the Services will function or be available at all without interruption or disruption, or that it will be free from unauthorized access.

16. Modifications to the App and/or the Site
Hugs and Words reserves all rights to change, correct, amend or enhance, improve, or discontinue temporarily or permanently the Site or the App (or any portion thereof), without notice. You acknowledge that the Site and/or App can be modified, expanded in content or format, or removed without notice to you. Hugs and Words will not be held responsible for any modification, suspension or discontinuance of this Site or App, or any Content contained therein. Hugs and Words will not be responsible for any errors or other malfunctions that might occur as a result of such modifications.
Hugs And Words may provide you with updates, upgrades, or new versions ("Updates"), according to its then current policies. This could include automatic updating or upgrading of the App without additional notice. The Terms will govern any such Updates unless they are accompanied or incorporated into a separate license agreement. All references to the App will include such Updates. Hugs and Words is not obligated to provide updates.
The bottom line is that we may discontinue, change or update the App and/or Site at any time. We are not liable for any problems that might result.

17. Disclaimer on Warranties
The Site, App, Content, User-Generated Content, and/or Services are provided "as is" and "as offered". Hugs And Words and its vendors, officers and shareholders, directors, employees and affiliates (collectively "Hugs And Words"'s representatives") disclaim any warranties regarding the Site, App, and/or Services. This includes implied warranties of merchantability, merchantability and fitness for a specific purpose, non-infringement, course of performance, and warranties of title. This agreement does not affect any additional consumer rights that may exist under local laws.
Site, App, and/or Services are for informational purposes only. They should not be considered or used in place of professional advice. We cannot guarantee that the information is accurate for your specific situation as laws vary from one country to another. For specific information, you should consult an expert attorney, tax professional or financial advisor. Hugs And Words, and Hugs And Words's agents, do not assume responsibility for any loss, damages, or actions that may be incurred due to the Site, App, and/or Services, including the Helpline service. Hugs and Words cannot guarantee that all User's needs are met.
We cannot guarantee that backups will be available for data we process as part of our Services. As such, we are not able to guarantee that such data will be available. We do not provide any archive services to store such data. We are not responsible for any unauthorised access to, use, security intrusions, failures to store, or any other damage or loss to such data.
Hugs and Words is not responsible for any User-Generated Content. This includes, but is not limited to, descriptions of deals and commodities that are offered via the app. Hugs and Words does not hold Hugs and Words liable in any way. If User-Generated content contradicts or conflicts with information you have received from another user of the App, information provided by that User shall prevail.
Hugs And Words does not warrant (I) that the Site or the App will work correctly, promptly, accurately, uninterrupted, free from viruses, worms or other harmful components, (iii), that the Site or the App will not contain errors or defects, or (iv) that the Site or the App will be compatible with any other software, hardware, or equipment. Hugs And Words is not responsible for any loss or inconvenience caused by interoperability issues. We make no representations regarding the use, inability, or operation of the Site, the App, Content, and/or User-Generated content available on the App, nor the results thereof (including whether the Site or the App will meet all your requirements).
Hugs And Words, Hugs And Words's representatives, disclaim all warranties or conditions regarding the use of this Site and/or its App. They are not responsible for any error or fault related to the Content and/or information within the Site or the App.
Hugs and Words is not responsible for the services or products provided by anyone or entity.
We are not responsible if you or anyone else suffers from technical problems, including without limitation slow connections, traffic congestion and overload of servers, delays, interruptions, or other issues related to the internet.
You understand and agree that your use of the Site, the App, and/or Content and/or User-Generated Content is at your sole risk.
Some jurisdictions may not allow certain exclusions or limitations. In these cases, it is possible that the entire extent of the limitations and exclusions listed herein may not be applicable.

18. Limitation of liability
Hugs And Words and Hugs And Words’s representatives will not be held responsible for any damages, except as permitted by law.
Hugs And Words, and Hugs And Words's representative's, total liability for any damages or losses arising from your use of the Site, the App, or the Services or Content, shall be limited to the amount you actually pay Hugs And Words, if any. The lesser amount is US$1.00. These usage rules contain the limitations of liability provisions applicable to any responsibility of the platform provider. Hugs And Words or its representatives will not allow you to seek any other damages.
Some jurisdictions may not allow certain exclusions or limitations, so the full scope of the limitations and exclusions herein may not be applicable.

19. Indemnification
Hugs And Words, its affiliates, licensors and service providers, as well as their respective officers, directors and employees, contractors and agents, attorneys, licensed licensors suppliers, successors, or assigns, from and against any claims, damages and liabilities (including attorneys' fees), resulting from: (i), your use, misuse, or activities related to the Site, the App, the Content, the User-Generated content and/or Services; (iii), your violation any rights of the Site or the App; and/the App; and/////the App; and/v) any other party in relation to the Site or the App, or the Site or the App; or the Site or the Site or the App; or the Site or the Site or the Site or the App, direct, special, or consequential damage, either indirect, or the Site or the Site or the App. This indemnification obligation is subject to these Terms.
We reserve the right to assume defence and control over any matter subject to indemnification by your company. This will not exempt you from your indemnity obligations under this agreement. In such cases, you will cooperate fully with us in asserting any defence. Without our express written consent, you agree to not settle any matter that is subject to indemnification.

20. Termination or Suspension
These Terms will remain in force until they are terminated, as provided herein.
Failure to follow these Terms will result in your licence being terminated. Hugs and Words can immediately suspend, terminate, or temporarily limit your account if you fail to follow these Terms. Hugs And Words may immediately suspend or terminate your account if you object to any of these Terms, as amended from time-to-time. These Terms will be terminated immediately. The Terms will not be affected by the following: Intellectual Property, Disclaimer of Warranties and Limitation of Liability, Indemnification, and General sections.
Hugs and Words may, at any moment, suspend or terminate the operation of any portion of the Services, temporarily or permanently. Hugs and Words can also correct, modify or amend any information on the Site or the App and correct, modify or enhance or improve it, and discontinue providing information, content, or features therein without prior notice. Hugs And Words will not be held responsible for any termination of operation of the App and/or Site, or loss of data.
We can suspend your access to your account if we feel that there is a danger to the security and privacy of your Account. In the event of such suspension, we may send you to notice. You will be unable to access or use your Account during such suspension. If we determine that the reason behind your Account suspension has been solved, we will restore your access to it.

21. Export and the location of the user
The App could be subject to export control laws in Finland and/or additional export control laws that are applicable to the User, or within the User's jurisdiction. This includes the United States. The User agrees to not export, transfer, or ship the App into any country or makes the App available for use in any way that is prohibited by applicable laws.
In addition, the User represents and warrants that (i) he/she is not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist-supporting" country; and (ii) that the User is not named on any U.S. Government list of prohibited or restricted parties.

22. Minors
You must be at least eighteen (18) to use the App and the related Services. We reserve the right at any time to ask for proof of age so that we can ensure that the App (and related Services) is not being used by minors younger than eighteen (18). If we learn that a minor (18-year-old) is using the App (and related Services), we will immediately block and ban that user from accessing the App. We will also make every effort to delete any Personal Information (as defined in our Privacy Policy) regarding such a User.

23. Modifications to the Terms
Hugs and Words reserves the right to change these Terms at any time. We will post any material changes on the Site or the App and, if necessary, send you an email to inform you (in the case that we have received your email address). These material changes will be effective seven days after they are posted on the Site or App, or sent by email. All other modifications to these Terms will be effective at the "Last Revised” date. Your continued use of the App and/or Site after that date will signify your acceptance of those changes and you agree to be bound. If the Terms need to be modified in order to meet any legal requirements, amendments can take effect immediately or as required by law without prior notice.
